These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Customer," or "You") and Prospyrity ("Brand," "We," "Us," or "Our"), governing your access to and use of our website, services, and the purchase of our products.
By browsing our website, creating an account, or purchasing any product from Prospyrity, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and our Return, Replacement & Refund Policy. If you do not agree with any part of these Terms, you must discontinue using our platform immediately.
1. Eligibility & Platform Access
By using this website, you represent that you are at least 18 years of age and competent to enter into a legally binding contract under the Indian Contract Act, 1872.
If you are accessing or using our services on behalf of an entity or another individual, you represent and warrant that you possess full authority to bind that entity or individual to these Terms.
We reserve the right to refuse service, terminate accounts, remove content, or cancel orders at our sole discretion without prior notice if fraudulent activity, misuse, or violation of these Terms is detected.
2. Products & Natural Mineral Characteristics
100% Natural Specimens: Prospyrity specializes in genuine earth minerals, raw pyrite clusters, gemstone bracelets, and handcrafted Vastu artifacts. You acknowledge that natural crystals are products of geological processes formed over millions of years.
Inherent Variations: Natural inclusions, micro-fissures, irregular surface textures, color variations, weight tolerances, and metallic luster variations are organic characteristics of authentic stones and do not constitute defects.
Visual Representation: Product photographs on our website are taken under studio lighting to show mineral details. While we make every effort to display colors and dimensions accurately, variations across monitor settings and screen calibrations may occur. The actual physical specimen delivered may slightly vary in geometric shape and internal banding from catalog imagery. Please also not that along with softwares we are also utilizing AI Tools to generate some product images while keeping reference to the original product image only for the product representation purpose.
3. Spiritual, Vastu & Metaphysical Disclaimer
Faith & Intention Based: All metaphysical properties, astrological benefits, Vastu recommendations, and healing properties described on our website, marketing materials, and product inserts are derived from traditional folklore, historical crystal lore, and Vedic texts.
No Medical or Financial Guarantee: Our crystals, bracelets, frames, and energization rituals (Pran Pratishtha) are spiritual and decorative lifestyle aids. They are not substitutes for professional medical diagnosis, psychological treatment, legal counsel, or certified financial advice.
Individual Discretion: Prospyrity makes no claims or absolute guarantees regarding personal financial gains, business windfalls, health transformations, or specific life outcomes resulting from the possession or use of our products. User discretion and faith-based practices are advised.
4. Pricing, Taxes & Orders
Currency & Taxes: All prices listed on Prospyrity are denominated in Indian Rupees (INR). In accordance with Indian tax laws, product prices shown are inclusive of applicable Goods and Services Tax (GST) unless specified otherwise.
Price Changes: We reserve the right to alter pricing, introduce promotional rates, or modify catalog availability at any time without prior liability.
Order Acceptance: Receiving an order confirmation email or SMS does not constitute final acceptance of your order. Prospyrity reserves the right to reject, hold, or cancel any order due to stock unavailability, pricing inaccuracies, technical glitches, or suspicion of fraudulent transactions. If an order is cancelled post-payment, a full refund will be processed to the original payment source.
5. Payments & Cash on Delivery (COD)
Prepaid Payments: We accept valid UPI, Net Banking, Debit Cards, Credit Cards, and authorized digital wallets via certified, encrypted payment gateways. We do not store your banking passwords, CVVs, or card credentials.
Cash on Delivery (COD): COD is offered as a convenience for select pin codes across India. By selecting COD, you commit to paying the exact cash amount to the courier personnel upon delivery.
COD Abuse & Refusal: Intentionally refusing a COD parcel at the doorstep without prior cancellation (prior to shipment dispatch) incurs logistics losses. Prospyrity reserves the right to permanently blacklist delivery addresses, restrict future COD access, and report fraudulent buying behavior across shared e-commerce logistics risk registries.
6. Domestic Shipping & Delivery
Territory: Prospyrity currently delivers exclusively within the domestic borders of the Republic of India.
Dispatch & Timelines: Standard orders are typically dispatched within 24–48 business hours via contracted third-party logistics partners (e.g., Delhivery, Bluedart, Xpressbees, India Post). Standard delivery transit times range between 3 to 7 business days depending on destination tier and accessibility.
Logistics Delays: While we strive for timely deliveries, Prospyrity shall not be held liable for courier delays resulting from adverse weather conditions, natural disasters, national strikes, regional lockdowns, or incorrect customer address inputs.
Transit Risk & Inspection: Risk of transit loss transfers to the customer upon delivery confirmation by the courier partner. Customers must inspect outer packaging upon arrival. If the parcel appears visibly crushed, tampered with, or retaped, do not accept the package or ensure the tamper state is recorded with the delivery agent.
7. Returns, Replacements & Unboxing Verification
All returns, transit damages, and replacement requests are strictly governed by our 7-Day Return, Replacement & Refund Policy.
Mandatory Unboxing Video: Because our products include delicate natural specimens and framed glass art, claims for physical breakage, missing items, or incorrect dispatches must be supported by a continuous, uncut 360-degree video recording beginning before the courier package seal is broken. Claims submitted without valid video evidence will be rejected.
Custom, resized, energized items that have been worn or integrated into daily personal rituals cannot be returned due to sacred contamination boundaries, except in proven cases of transit breakage.
8. Intellectual Property Rights
All digital and physical content published by Prospyrity—including brand names, logos, typography, visual photography, graphics, product descriptions, copy, website layout, and custom software integrations—is the proprietary intellectual property of Prospyrity and protected under the Copyright Act, 1957 and Trade Marks Act, 1999 of India.
You may not copy, scrape, reproduce, republish, resell, or exploit any portion of our intellectual assets, products, or descriptions for commercial or competitor use without prior written consent.
9. Prohibited Platform Conduct
You agree not to use the platform to:
Transmit malicious code, trojans, worms, or automated bots designed to disrupt website performance or extract data.
Attempt unauthorized access to our administrative servers, hosting infrastructure, or user databases.
Post or transmit defamatory, abusive, obscene, fraudulent, or unlawful communications in product reviews, website forms, or customer support channels.
Impersonate another individual, forge digital signatures, or utilize stolen payment methods.
10. Limitation of Liability & Indemnification
To the maximum extent permitted by applicable Indian law, Prospyrity, its founders, directors, employees, affiliates, and suppliers shall not be liable for any indirect, incidental, special, punitive, or consequential damages resulting from the purchase, use, or inability to use our products or services.
In any event, Prospyrity's total cumulative liability arising out of or related to these Terms or any purchased product shall not exceed the actual invoice amount paid by you for the specific transaction in dispute.
You agree to indemnify, defend, and hold harmless Prospyrity from and against any third-party claims, liabilities, damages, costs, and expenses (including legal fees) arising from your breach of these Terms, misrepresentation, or violation of any law.
11. Governing Law & Dispute Resolution
These Terms shall be governed, interpreted, and construed in accordance with the substantive laws of India, without regard to conflict of law principles.
Any disputes, controversies, claims, or legal proceedings arising out of or in connection with these Terms, platform usage, or purchases from Prospyrity shall be subject to the exclusive jurisdiction of the competent courts located in Jaipur, Rajasthan, India.
